Mayor Mark Dion and the city council met in executive session on Monday evening, January 26 to discuss participating in a lawsuit in support of Minnesota and the Twin Cities.  During the meeting they received legal guidance regarding litigation in the case of State of Minnesota v. Noem, 0:26-CV-00190 (D. Minn.)  The case seeks declaratoy and injunctive relief against the federal government’s unconstitutional immigration enforcement tactics involved in the surge of ICE agents in Minnesota according to a press release received this evening.

“I received a communication last week fkrom the City of Boston’s Legal Department inquiring about whether Portland would join an anicus brief tht they, along with various city and county governments from around the country, were filing in a lawsuit brought by the State of Minnesota and the cities of Minneapolis and St. Paul against certain federal defendants, including the US Departments of Homeland Security, Immigration and Customs Enforcement and Customs and Border Protection and several director and officials in those departments,” said Mayor Mark Dion.

He added:  “Unfortunatly, the request for the City to join the amicus brief came far too late for the Council to join the action for  a temporry restraining order directed at ICE enforcement activities in Minnesota.  Last night, the Council met in executive session to discuss how to show support for Minnesota and the Twin Cities in their lawsuit and we hope to bring forwrd  a resollution for the Council to consider next week that would permit the city to support appellate litigation challengig unlawful immigration enforcement.’
