A federal court Judge in New Hampshire today blocked President Trump’s Executive Order that strips specific babies born in the US of their US citizenship. The ruling by US District Judge Joseph N. Laplante is the latest in a series of court rulings rejecting Trump’s executive order since it was signed January 20th.
“Today’s ruling is the latest rebuke of President Trump’s wildly unconstitutional bid to end birthright citizenship,” said Cody Wofsey, deputy director of the ACLU’s Immigrants’ Rights Project, who argued the case. “This attempt to deny babies their citizenship is as illegal as it is inhumane and we will keep fighting until we stop this Order for good.”
In a significant legal development, U.S. District Judge Joseph N. Laplante in New Hampshire has blocked President Donald Trump’s executive order aimed at ending birthright citizenship for certain children born in the United States. This ruling, issued on February 10, 2025, marks the third federal injunction against the order since its signing on January 20, 2025.
The executive order sought to reinterpret the 14th Amendment’s Citizenship Clause, challenging the long-standing principle that grants citizenship to anyone born on U.S. soil, regardless of their parents’ immigration status. Legal experts and immigrant advocacy groups have criticized the order as unconstitutional and inhumane. Cody Wofsy, deputy director of the ACLU’s Immigrants’ Rights Project, who argued the case, stated, “This attempt to deny babies their citizenship is as illegal as it is inhumane, and we will keep fighting until we stop this order for good.”
This ruling adds to a series of judicial decisions blocking the executive order. Previously, federal judges in Seattle and Maryland issued similar injunctions, emphasizing the order’s conflict with the Constitution’s clear language and established legal precedents. These consistent judicial responses underscore the challenges the administration faces in its efforts to alter birthright citizenship policies.
As the legal battles continue, the future of the executive order remains uncertain. The administration is expected to appeal these decisions, potentially setting the stage for a Supreme Court review. In the meantime, the injunctions prevent the enforcement of the order, maintaining the status quo regarding birthright citizenship in the United States.
