
AG Aaron M. Frey Joined 18 Other States in Filing a LawsuitAgainst Convicted Felon Trump’s Unconstitutional Executive Orderto End Birthright Citizenship in US.
Attorney General Aaron M. Frey today announced that he and 18 other states are challenging President Donald Trump’s Exeuctive Order, ending birthright citizenship which violates the constitutional rights to which all children born in the US are entitled.
The suit was filed in the US District Court District of Massachusetts. It seeks to invalidate the Executive Order and to enjoin any actions taken to implement it. The states request immediate relief to prevent the President’s Order from taking effect through both a Temporary Restraining Order and a Preliminary Injunction.
As the filing indicates, birthright citizenship dates back centuries – includimg to pre-Civil War America. Although the Supreme Court’s notorious decision in Dred Scott denied birthright citizenship to the descendents of slaves, the post Civil War US adopted the Fourteenth Amendment to protect citizenship for children born in the country. As the Attorney General’s filing also explains, the US Supreme Court has twice upheld birthright ciizenship, regardless of the immigration status of the baby’s parents.
The ACLu of Maine has filed a similar suit to the above by AG Frey.
